General Terms and Licence Conditions for CN1 Discover
English translation of the German original. In case of discrepancies, the German version prevails, subject to mandatory law.

1. Provider, validity and subject matter of the contract
The provider is Neumann IT Solutions, Christian Neumann, Burghügelweg 1, 9604 Lütisburg, Switzerland. These conditions apply to the free use of CN1 Discover as well as to the purchase and use of the Pro and Team editions.
The subject of the contract for the paid editions is a simple and non-transferable right of use for the ordered edition and number of licenses, which is limited to the paid subscription period. Mandatory rights of consumers remain reserved.
2. Installation and activation
CN1 Discover is installed and updated as a free Windows app via the Microsoft Store. Pro and Team are not separate programs or downloads. After a successful purchase, the customer receives an activation code with which the selected edition is activated within the installed app.
To use a paid edition, CN1 Discover must first be installed from the Microsoft Store. The Microsoft terms and conditions also apply to purchase, installation and updates via the store.
3. Editions and scope of services
The Free edition may be used permanently free of charge within its published scope of functions. CN1 Discover Pro includes one licence; CN1 Discover Team includes three licences. The specific scope of functions is set out in the service description applicable at the time of ordering.
Pro features include customer projects, measurement history, comparison of saved measurements, PDF reports, project import and export, and deliberate export of detection feedback. The Team edition provides the Pro features for three installation licences with joint ordering and billing.
4. Licence and activation code
Each licence entitles the customer to activate and use the ordered edition within the intended licence scope. The activation code must be stored securely and may not be published, sold, rented or disclosed to unauthorised third parties. The customer is responsible for actions performed using their activation code to the extent that such actions are attributable to the customer.
In the event of loss, device replacement or technical problems, Neumann IT Solutions provides support at support@cn1.ch. There is no entitlement to simultaneous activations beyond the ordered scope.
5. Technical requirements and permitted use
The customer shall ensure a Windows system supported by CN1 Discover, access to the Microsoft Store, network access and the necessary local rights. Networks and devices may only be analyzed if the user is authorized to do so. The customer is responsible for the lawful use and protection of exported project and diagnostic data.
6. Meaning of the diagnosis
Network topology and device classification are based on available technical observations. Not every physical connection can be determined with certainty without administrative access. ICMP packet size measurements are active path estimates and are not a replacement for a real user data throughput measurement with a controlled remote site. The product supports troubleshooting, but does not guarantee the detection of every device or every malfunction.
7. Order and conclusion of contract
The editions and prices shown on the product page invite you to order. Using the “Order Pro” or “Order Team” button, the customer can access the secure purchase process from Stripe. Before completing the payment transaction, he can check and correct the order details, price and payment method.
The contract for a fee is concluded upon successful completion of payment and electronic confirmation. The activation code is then provided electronically. The customer is obliged to provide an accessible and correct email address when ordering.
8. Prices and Payment
All prices published on the product page are final prices in Swiss francs including 8.1% Swiss VAT. Pro costs CHF 99 per year for a license; Team costs CHF 249 per year for three licenses. Payment, subscription and billing management are handled via Stripe.
In the event of a pending or failed payment, the use of paid features may be restricted upon reasonable notice. Locally saved projects and measurement data are not automatically deleted.
9. Term, renewal and termination
Paid annual subscriptions run for one year from conclusion of the contract and renew automatically for a further year until terminated. The subscription may be terminated before the next renewal through the Stripe customer portal linked in the purchase confirmation or by contacting support@cn1.ch. Termination takes effect at the end of the period already paid for.
Price changes apply no earlier than the next renewal and will be announced in text form at least 30 days in advance. The customer may terminate the subscription before renewal.
10. Right of withdrawal and refunds
Swiss law does not provide a general statutory right of withdrawal for online purchases. Neumann IT Solutions does not grant an additional voluntary right of withdrawal. Subscription periods already paid for are not refunded pro rata once activation has begun.
Mandatory withdrawal, warranty or refund rights that apply in particular because of the customer's place of residence remain unaffected. In the event of an incorrect duplicate charge, or if the licence cannot be provided despite successful payment, contact support@cn1.ch.
11. Updates and Changes
Security, stability, compatibility and bug fixes are provided via the Microsoft Store. Installation of current versions may be required for continued safe and reliable use. An update does not delete local customer projects or measurement histories without explicit action from the user.
Significant changes to price, scope of services or data protection will be communicated transparently before they take effect. Changes to the detriment of the customer during a period that has already been paid for will only be made for objective reasons and in compliance with mandatory rights.
12. Availability, Warranty and Liability
CN1 Discover supports network diagnostics, but does not replace testing by a qualified specialist. Neumann IT Solutions strives to provide a reliable licensing service, but does not owe any uninterrupted availability of Microsoft Store, Internet access or third-party services at all times.
Mandatory statutory warranty and liability claims as well as liability for intent, gross negligence and personal injury remain unaffected. To the extent permitted by law, there is no liability for decisions based solely on estimated or unclear network values, or for indirect damages and lost profits.
13. Data protection
The CN1 Discover Privacy Policy applies. Local topologies, device information, projects and measurement histories are not automatically transmitted to Neumann IT Solutions.
14. End of contract
After the end of the contract, the right to use the paid functions expires. The free edition can continue to be used in the published range of functions. Locally existing project and export files remain with the customer; Their further storage or deletion is his responsibility.
15. Final provisions, governing law and jurisdiction
If any provision of these terms is or becomes invalid, the remaining provisions remain effective. Swiss law applies. Jurisdiction at the provider's registered office applies only where it is not precluded by mandatory consumer protection or jurisdiction rules.
